In January of 2016 the most important water case in Canada will be heard before the Supreme Court. Launched by a private citizen from Rosebud, Alberta, scientist Jessica Ernst will be petitioning the Supreme Court for the right to sue the Alberta Energy Regulator for violating her charter rights after allowing Encana Corp. to frack and contaminate her well water and that of her community.
Jessica’s fight is immensely important to all of us for she stands for ordinary people who have never had the chance to be heard by the highest court in our country. Through her we are given a rare opportunity to stand up to the oil giants who are destroying our water – the most precious resource on which all of life rests.

Jessica’s battle began over 9 years ago when she discovered her well water was contaminated by Encana Corp. Encana, like many oil companies are widely employing a controversial method of gas and oil extraction commonly referred to as ‘Hydraulic Fracturing’ or ‘Fracking’.
For many of the wells that are ‘fracked’, millions of gallons of water are required. Fresh water is taken out of the system, infused with toxic chemicals and gases; ultimately requiring deep underground disposal. This in itself becomes a danger (see link below). More often than not, ground and surface water is contaminated by the fracking process - it’s a theme that has become all too common and one that needs to be stopped.
Oil giants get billions in subsidies and spend millions lobbying the government for the right to drill and frack. Their efforts have granted them access to pillage valuable mineral resources on private and public lands as never before. The added bonus is when problems occur, there is little accountability. Landowners quickly find they have next to no protection when their land and water become polluted.
Those who try to take the matter to court soon discover they are powerless against the billion dollar oil industry. Most don’t have the background or the resources to fight so either suffer in silence or are bought off by the oil company.
What makes Jessica’s case unique and what gives us hope are her credentials, her ethics and her integrity. As a scientist who has been in the industry for 30 years, she understands better than anyone the technology and the mindset of what we are up against. This rare combination has allowed her to remain standing after a series of long and gruelling court battles. We have much to be thankful for in Jessica and more than ever need to show her our support.
Years of litigation have generated huge legal bills and associated expenses with more on the horizon.
We ask all of you who believe in the importance of water and our constitutional rights to speak out when harmed by the oil and gas industry and our enabling regulators to be part of this historic battle by supporting Jessica in her fight for clean safe water.
